1. Acceptance of Terms

By accessing, downloading, installing, or using Remove Background Pro ("the App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

These Terms of Service ("Terms") constitute a legally binding agreement between you and Remove Background Pro. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the App after any such modifications constitutes your acceptance of the modified Terms.

2. Description of Service

Remove Background Pro is a mobile application that provides background removal and image editing services. The App uses on-device processing to remove backgrounds from images using Apple's Vision framework. All processing occurs locally on your device, and images are never uploaded to our servers.

The App offers both free and premium subscription tiers:

  • Free Tier: Limited number of background removals per period
  • Pro Subscription: Unlimited background removals, high-resolution export, advanced refine tools, and no watermarks

3. Use License

Permission is granted to use Remove Background Pro for personal and commercial purposes, subject to the following restrictions:

  • You may not modify, adapt, or reverse engineer the App or attempt to extract the source code
  • You may not remove any copyright, trademark, or other proprietary notices from the App
  • You may not use the App in any way that violates applicable laws or regulations
  • You may not use the App to process images that infringe upon the rights of others, including copyright, trademark, or privacy rights
  • You may not use automated systems or bots to access or use the App

This license is revocable at any time without notice and with or without cause.

4. Subscriptions and Billing

4.1 Subscription Plans

Remove Background Pro offers subscription plans with different billing periods (e.g., weekly, yearly). Subscription prices and features are subject to change. We will notify you of any price changes in advance.

4.2 Free Trial

Some subscription plans may include a free trial period. The free trial allows you to access Pro features for a limited time without charge. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

You may only use one free trial per subscription plan. If you have previously used a free trial for a particular plan, you will not be eligible for another free trial for that same plan.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel your subscription at least 24 hours before the end of the current billing period. By subscribing, you authorize us to charge your Apple ID account for the renewal period.

The renewal charge will be the same as the original subscription price, unless we notify you of a price change in advance. You will be charged within 24 hours prior to the end of the current period.

4.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. You will continue to have access to Pro features until the end of the period you have already paid for.

To cancel:

  1. Open the Settings app on your iOS device
  2. Tap your name at the top
  3. Tap "Subscriptions"
  4. Select Remove Background Pro
  5. Tap "Cancel Subscription"

4.5 Refunds

All subscription purchases are processed by Apple through the App Store. Refund requests must be submitted to Apple through their standard refund process. We do not process refunds directly.

You may be eligible for a refund if:

  • You cancel within the refund period specified by Apple's refund policy
  • You experience technical issues that prevent you from using the App
  • You were charged incorrectly due to a technical error

To request a refund, contact Apple Support or visit reportaproblem.apple.com.

4.6 Price Changes

We reserve the right to change subscription prices at any time. If we increase the price of your subscription, we will notify you at least 30 days in advance. If you do not wish to accept the new price, you may cancel your subscription before the price change takes effect.

5. User Content and Intellectual Property

5.1 Your Content

You retain all rights to any images or content you process using Remove Background Pro. We do not claim ownership of your content. By using the App, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the background removal service on your device.

Since all processing occurs locally on your device, we never have access to, store, or transmit your images.

5.2 Our Intellectual Property

The App, including its design, features, functionality, and all content (except your images), is owned by Remove Background Pro and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

5.3 User-Generated Content

You are solely responsible for the images you process using the App. You represent and warrant that:

  • You own or have the necessary rights to use and process the images
  • Your use of the images does not violate any third-party rights
  • Your images do not contain illegal, harmful, or offensive content

6. Prohibited Uses

You may not use the App:

  • In any way that violates any applicable national or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
  • In any way that infringes upon the rights of others, including intellectual property, privacy, or publicity rights
  • To process images containing illegal content, including but not limited to child exploitation material, hate speech, or content that promotes violence
  • To process images in a way that violates the privacy or rights of individuals depicted in the images
  • To reverse engineer, decompile, or disassemble the App
  • To use automated systems, bots, or scripts to access or use the App

7. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

We may release updates to the App that add, modify, or remove features. We are not obligated to provide any specific features or maintain backward compatibility with older versions of the App.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF THE BACKGROUND REMOVAL RESULTS

Background removal results may vary depending on image quality, content, lighting, and other factors. We do not guarantee that the App will produce perfect results for all images.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL REMOVE BACKGROUND PRO, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES
  • LOSS OF USE OF THE APP
  • BUSINESS INTERRUPTION
  • PERSONAL INJURY OR PROPERTY DAMAGE

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Remove Background Pro, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content you process using the App

11. Third-Party Services

The App may integrate with or use third-party services, including:

  • Apple App Store: For subscription management and payment processing
  • Apple Vision Framework: For on-device image processing

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of any third-party services.

12. Account Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees
  • Extended periods of inactivity

Upon termination, your right to use the App will immediately cease. If your subscription is terminated due to a violation of these Terms, you will not be entitled to a refund of any fees paid.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Remove Background Pro operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration organization, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Remove Background Pro regarding the use of the App and supersede all prior agreements and understandings.

17. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Remove Background Pro, not Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide support or maintenance for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.
  • Apple is not responsible for addressing any claims you have or any claims of any third party relating to the App or your possession and use of the App.
  • In the event of any third-party claim that the App infringes that third party's intellectual property rights, Remove Background Pro, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
